Terms of Service

1. General

These Terms of Service ("Terms") govern your use of avots.ai ("Service"), operated by SIA TWIN ("Company"). By creating an account or using the Service, you agree to these Terms.

2. Description of Service

avots.ai is an AI model aggregator platform that provides access to multiple third-party AI models (text, image, audio, video) through a unified interface. The Service acts as an intermediary, routing your requests to AI model providers via OpenRouter for text/reasoning and Fal.ai for media generation.

We do not develop or control the AI models themselves. AI-generated responses may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and verifying any output.

3. Account Registration

• You must be at least 16 years old to create an account
• You must provide accurate information during registration
• You are responsible for maintaining the security of your account
• One person may maintain only one account

4. Subscription Plans and Payments

• The Service offers free and paid subscription plans (Starter, Beginner, Fullhouse, Complete, VIP)
• Paid plans are billed on a recurring basis (monthly, quarterly, semi-annually, or annually) when paying by card
• Prices are displayed in euros (EUR) and include applicable VAT
• Token-based usage: each plan includes a monthly token allocation. Additional tokens can be purchased up to 5 times per billing period
• Token expiry: Subscription tokens reset on each renewal and do not roll over. Purchased top-up tokens are valid for 30 days from the date of purchase
• One-time Starter Pack: a single €0.99 offer for 1,000 tokens, redeemable once per account across both payment methods

5. Payment Methods and Tax Handling

We offer two ways to pay. Tax treatment depends on the method you select:

• Card payments (Stripe - Merchant of Record). Card transactions are processed by Stripe Payments Europe Limited acting as the Merchant of Record under the Stripe Managed Payments programme. Stripe sells the subscription to you, collects the applicable VAT or sales tax in your jurisdiction (80+ countries supported, including all EU member states), remits that tax to the relevant authority, and issues the tax receipt directly to you. For an official VAT invoice, use your Stripe customer portal or contact Stripe support. SIA TWIN receives a net payout from Stripe after fees and tax. By subscribing you also agree to Stripe's Terms and Stripe Services Agreement.
• Cryptocurrency payments (CoinGate). Crypto orders are processed by CoinGate, UAB. SIA TWIN is the seller of record for these transactions; CoinGate converts your crypto payment to EUR at the rate locked at order creation. Latvian VAT (PVN, 21%) is included in the displayed price. SIA TWIN issues the VAT invoice from this Service. Cryptocurrency subscriptions do not auto-renew - we will email you a renewal payment link approximately three days before your subscription period ends; if no on-time renewal payment is received, your account is automatically moved to the Free plan at the end of the period.

6. Refund Policy

• You may cancel your subscription at any time. Access continues until the end of the paid period.
• Card-paid subscriptions: refundable within 14 days of the initial purchase if no AI generation tokens have been consumed. Refund requests must go through the same channel that processed the payment (Stripe).
• Crypto-paid subscriptions: due to cryptocurrency price volatility, refunds for crypto orders are issued at our discretion and, if approved, may be made in EUR via bank transfer at the rate captured at order creation. We cannot refund the same crypto amount that was originally sent.
• Token top-up purchases and the Starter Pack are non-refundable once any token from the purchase has been consumed.
• To request a refund, contact hello@avots.ai with your invoice number.

7. Acceptable Use

You agree not to:

• Use the Service for illegal purposes or to generate illegal content
• Attempt to bypass usage limits or exploit the token system
• Share your account credentials with others
• Use automated tools to access the Service without permission
• Reverse engineer or attempt to extract source code
• Generate content that violates the policies of underlying AI providers
• Use the Service to harm, harass, or deceive others

8. Intellectual Property

• The avots.ai platform, brand, and interface are owned by SIA TWIN
• Content generated through AI models is subject to the respective AI provider's terms
• You retain rights to your input content (prompts, uploaded files)
• We do not claim ownership of AI-generated outputs

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.

10. Partner Program

• Users can earn commissions by referring new paying users
• Level 1: 10% commission from direct referral payments
• Level 2: 5% commission from payments of users referred by your referrals
• Commissions are credited to a separate balance and can be withdrawn upon request
• We reserve the right to cancel commissions in cases of fraud or abuse

11. Service Availability

We strive to maintain continuous availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any losses resulting from service interruptions.

12. Limitation of Liability

• The Service is provided "as is" without warranties of any kind
• We are not responsible for the accuracy, quality, or appropriateness of AI-generated content
• Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages

13. Termination

• You may delete your account at any time through Settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

14. Governing Law

These Terms are governed by the laws of the Republic of Latvia. Any disputes shall be resolved in the courts of Riga, Latvia.

15. Changes

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of significant changes via email or in-app notification.
